Terms and Conditions

If any payment is made through Cheque / PO and dishonored, Al-Jannat Residencia may, at its sole discretion, either provide the applicant another opportunity to clear the outstanding amount or cancel the reservation of the applicant.

In addition to the payment as per schedule, all other dues, charges, fee, Taxes etc. payable under the applicable law, the applicant / allottee shall be liable to pay on demand. Moreover, the applicant shall also be liable to pay the escalation charges due to development cost it so required.

In case, if any allottee fails to pay 3 successive installments within the prescribed period, the allotment is liable to be canceled without notice. In the event of cancellation of the property, the submitted payment will be refunded with the 15% deduction against booking amount of the plot as per the company policy without any profit, interest, or markup, however, the registration / processing fee already paid is non-refundable.

The allottee shall not sub-let, transfer or sell the plot and shop to anyone else without the prior permission of the company. However the plot/shop can be transferred from one buyer to another only by the company authorized person after the payment of prescribed transfer fee on the company authorized receipts. The presence of the seller will be compulsory.

The allottee shall abide by the all rules and regulations governing allotment. Possession, ownership. Construction framed e.g (covered area plus height damp level etc) issued and enforced by the management of the company from time to time.

In case of death of the buyer / applicant plot / shop will be transferred to the “legal heirs” on the basis of the decision of the competent authority or the court after the payment of transfer fee as prescribed by the company.

No applicant shall be entitled to claim or receive any interest / markup against the amount paid.

The plot number shall be given through computerized balloting. To be eligible for balloting, members should meet the criteria for balloting as decided by the Al-Jannat residencia. Al-Jannat residencia shall have right to decide the time of ballot and issuance of final allotment letter.

The right to make any adjustments (without notice) or change in the layout plan of the scheme as and when deemed appropriate is expressly reserved by Al-Jannat residencia.

For each preferential location i.e. corner, facing park, main road (100 feet) applicants will pay a 10% premium each after the balloting. In case of multiple preferences in location, the applicant will pay in multiples of 10%, 15% paid by the allottee.

A property allotted to an applicant shall not be used by the allottee for any purpose other than that applied or meant for.

The possession of the plot and final allotment letter will be issued to the applicant once he/she has cleared all the dues and paid the entire consideration as per schedule of payment and other charges etc.

At the time of possession, if any excess land if found with the plot the applicant shall remain liable to pay the price of excess land. In no case, the applicant would deny the payment of excess land. In case of doing so, Al-Jannat residencia will have full authority to cancel his/her plot and refund the booking amount after 15% deduction and to further reserve the right to sell the plot to anyone and applicant shall raise no objection to such cancellation & sale.

In case at the time of possession if the land of the plot short, the applicant shall be refunded for the less area as per booking rate.

The management reserves to allot, or sell a property canceled from the name of the allottee/transferee due to nonpayment of dues, or any reason whatsoever, to any other applicant or person and the ex-allottee/transferee shall have no right to such property. The management decision in this regard shall be final.

Any additional charges (if imposed) shall be payable as determined by the management from time to time.

In case the management for any reason, fails to allot a property, the applicant shall not make any claim of damage, compensation, or interest.

No allottee is authorized / allowed to go into any authority / institution or court of law against Al-Jannat residencia before the completion of installments and completion period of society. 

In case of any dispute with Al-Jannat residencia the matter shall be referred to arbitrator appointed by Al-Jannat residencia / sponsor whose decision shall be final and binding upon the applicant / parties. The cost of arbitration shall be borne by the applicant.

The applicant shall abide by all resolution adopted by the Al-Jannat residencia from time to time in respect of terms & condition of living in the housing scheme.

The applicant shall pay monthly charges against services rendered by Al-Jannat residencia and shall not challenge these charges/fee so fixed by Al-Jannat residencia in any manner.

The applicant at the time of taking possession of residential plot or property etc. will also be abide by all terms and condition mentioned herein-above and obtain all kind of NOCs from Al-Jannat residencia for commencement of any activity (construction) at the property.

The applicant shall abide by the approved layout plan of the housing scheme and will not use the plot other than purpose in the layout plan. In case of violation in the approved use of land, Al-Jannat residencia shall have right to seal the premises unless it is brought back to the original approved use.

The applicant shall abide by the above terms and conditions in additions to all bylaws, regulations and polices framed by Al-Jannat residencia from time to time. The allotment, use, possession, construction and cancellation on the plot shall remain subject to the terms and conditions.
